Notice of Intention to Sell Land

Horsham Rural City Council (Council) gives notice under Section 114(2)(b) of the Local Government Act 2020 (Act) and Council's community engagement policy, that it intends to sell its land located at 28 Firebrace Street Horsham Victoria 3400 being the land known as Lot 1 TP 813567Y Parish of Horsham volume 5931 folio 066 (Land).

The proposal is that the Land be sold by private treaty to the current tenant, Christian Emergency Food Centre (CEFC) ABN 79 590 217 561 (Purchaser) on the following key terms:

1.    a purchase price of $1.00 plus GST

2.    settlement to take place 30 days after the day of sale;

The CEFC is a registered Public Benevolent Institution registered with the Australian Charities and Not-for-profits Commission. The Land was purchased by Council in 2002 to allow the Purchaser to receive state government grant funding.  Further details are provided in the report to Council on 28 November 2022, an excerpt is available on this page which provides detailed background information.

Any person has a right to make a submission on the proposed sale. 

Submissions must be received by close of business on 14 January 2023 and should be addressed to the Chief Executive Officer, Horsham Rural City Council, PO Box 511, Horsham VIC 3402 or via email to council@hrcc.vic.gov.au .  Submissions received will form part of the public record of the relevant Council and Committee meetings.

Any person who has made a written submission to Council may request in writing that he or she be heard in person in support of the written submission or by a person acting on his or her behalf before Council (or a Committee of Council established for this purpose) at a time and date to be advised.
